Please read the following Privacy Policy to learn more about TVision Insights, Inc.’s and TVision Insights UK Limited’s (“TVision”) personal information practices. By using our audience engagement measurement equipment (the “System”) as a participant in the program (the “Program”), you acknowledge that you accept the practices and policies outlined in this Privacy Policy, and you have consented to our information practices, including the collection, use, and sharing of your information and your children’s information, if applicable. See the end of this Privacy Policy for specific information about our data practices with respect to children’s information.
Scope
This Privacy Policy covers TVision’s treatment of personal information ("Personal Information") of our Program participants. The System collects information from you and individuals in your household when you access or use our System, as well as any individuals incidentally in the vicinity of the System during your participation in the Program, such as guests to your home.
Changes to Our Privacy Policy
To the extent permitted by applicable law, from time to time we may change this Privacy Policy and we will alert you to changes by sending you an email. Where consent is required by applicable law, we will obtain your consent first prior to the effective date of the change.
Information We Collect
We collect the following categories of information on our Program participants from the applicable sources:
Information You Provide to Us:
We receive and store the following Personal Information that you provide to us when you decide to participate in the Program:
Identifiers such as first and last name; email address; physical address
Date of birth
Political opinions
Facial images
Demographic information (gender, age, race, ethnicity, city and state)
Information about your media consumption habits
Phone number
Automatically-Collected Information:
Whenever you or others interact with the System (including passively, by simply being in the vicinity of the System when it is on), we automatically receive and capture certain information from the System. This information may include
Certain audience media consumption data
Certain audio data, allowing us to recognize media (TV, video, other) being consumed
Photos, images, and face geometry (a biometric identifier used for facial recognition);
Color and depth sensory data
Outbound network traffic information which helps us determine the streaming services that streaming devices are using
We use this data to generate information about your engagement with media and share it as described below.
We may also collect information from third-party partners to augment what we know from the System and what you provide to us.
Use of Your Information
We use your Personal Information and other information we collect in connection with our System and the Program to: (1) gather information about audience engagement, analyze that data, combine that data with other data, anonymize and de-identify the data and create insights, and provide the anonymized, de-identified data and insights to our clients, partners and affiliates; (2) improve our services; (3) allow you to set up a user account and profile; (4) contact you; (5) respond to your service requests; (6) analyze how you use the System, (7) respond to legal requirements, requests and actions, protect the security of our business and our participants, and enforce our terms, and (8) the other uses described under “Disclosure of your Information” below. In certain cases, we may share Personal Information with third parties as described below.
Disclosure of Your Information
We may disclose your Personal Information to third parties for a business purpose. When we disclose personal information for a business purpose, we enter into a contract that describes the purpose and requires the recipient to both keep that Personal Information confidential and not use it for any purpose except performing the contract.
We may share your Personal Information and other information that we collect through the System with third parties as follows:
De-Identified Information: We may provide Personal Information and other information, in an anonymized, de-identified manner, to our clients, partners and affiliates for use for business and marketing purposes. We may also provide aggregated, anonymized usage data to our clients, partners and affiliates, who may use this data to understand how often and in what ways people use our System, so that they, too, can provide their users with an optimal viewing experience.
Vendors and Service Providers: We may employ third party vendors and service providers to perform tasks on our behalf, or to enable the System technology. We may share your information with these parties to enable them to perform these functions. For example, we may use a data hosting service to store and process information that we collect through the System. Unless you are otherwise informed, these third parties do not have any right to use Personal Information we share with them beyond what is necessary to assist us.
Business Transfers: Your information may be transferred in the event of a merger, acquisition, reorganization, bankruptcy, receivership, sale of company assets, or transition of service to another provider. Your information may be transferred to a successor or affiliate alone or as part of that transaction along with other assets.
Legal Requirements: We may disclose your information if required to do so by law or in the good faith belief that such action is necessary to (i) comply with a legal obligation, (ii) protect and defend the rights or property of TVision, (iii) act in urgent circumstances to protect the personal safety of users of the System or the public, or (iv) protect against legal liability.
With Your Consent: We may also share any information from or about you, including Personal Information and television and video viewing information, with any party when we have your consent.
Legal Grounds for Using Personal Information
We may have various legal grounds for using your Personal Information, including:
Using your Personal Information to perform our contract with you (or in order to take steps prior to entering into a contract with you)
Using your Personal Information with your consent (which you can withdraw at any time)
Using your Personal Information to comply with law
Using your Personal Information if necessary for our legitimate interests in a way that might be expected as part of operating our business and in a way which does not materially impact your rights and freedoms
Security
We have implemented appropriate technical and organizational controls to protect your Personal Information against unauthorised processing and against accidental loss, damage or destruction. Although we will do our best to protect your personal data once with us, we cannot guarantee the security of any personal data sent to our site while still in transit and so you provide it at your own risk.
International Data Transfers
Personal Information may be transferred to, stored or processed in any country where TVision or or TVision’s service providers are based or have facilities. Whenever we transfer your Personal Information outside of the UK, we endeavor to provide similar protection and put in place at least one of these safeguards:
We will only transfer your Personal Information to countries that have been found to provide an adequate level of protection for Personal Information or
We may also use specific approved contracts that use Standard Contractual Clauses for the protection of Personal Information with our affiliates or service providers that are based in countries outside the UK, including those based in the US. These contracts give your Personal Information the same protection it has in the UK.
If you are located in the UK, you may contact us for a copy of the safeguards which we have put in place for the transfer of your Personal Information outside the UK.
Retention
We keep your Personal Information for only as long as we need to. When you are no longer a participant in the Program and have returned our System, we will delete your Personal Information and/or anonymize certain information such that it is no longer deemed Personal Information. You may also request to have your Personal Information deleted, in which case, as noted above, you will no longer participate in the Program and need to return the System.

Your Rights
You may always opt not to disclose information to us, but keep in mind some information may be needed to register with us or to use the System and participate in the Program.
Our promotional emails contain an easy-to-use opt-out mechanism if you no longer want to receive promotional emails. You may also contact cs@tvisioninsights.com or call 020 7993 5337 in order to opt-out of receiving promotional emails. Please note that you may continue to receive emails from us concerning your participation in the Program after you opt out of receiving promotional messages from us.
You may withdraw your consent for TVision to share your media consumption information with third parties at any time by emailing us at cs@tvisioninsights.com or calling 020 7993 5337. Please note that withdrawing your consent may result in termination of your participation in the Program.
As a resident of the UK, you have a number of rights with regard to your Personal Information
Access: you have the right to request a copy of the Personal Information we hold about you
Rectification: you have the right to request that we correct the Personal Information we hold about you
Portability: you have the right to receive a machine-readable copy of your Personal Information
Deletion: you have the right to ask us to delete your Personal Information
Restrict: you have the right to ask us to restrict the processing of your Personal Information in certain circumstances
Object: you have the right to ask us to stop processing your Personal Information
Automated decision-making and profiling: you have the right to be free from decisions based on automated processing that produce a significant legal effect on you, unless necessary to perform a contract or you provide consent
Withdraw consent: you have the right to withdraw your consent at any time
Lodge complaint: you have the right to lodge a complaint with the data protection authority

Third-Party Applications and Services
This Privacy Policy applies only to the services provided by TVision. The policies and procedures we described here do not apply to any third-party applications or services.

Children Under Age 13
If you have children who are under 13 residing in your household we will need to obtain consent from the parent of each child before collection of personal information.
If we do not receive parental consent within a reasonable time, we will delete any information we collected from the child in connection with that activity.
We reserve the right to verify that the requester is in fact the child's parent or legal guardian. In any correspondence such as e-mail or mail, please include the child’s name and the parent’s email address and telephone number.
