TVision Privacy Policy For Children Under Age 13

The Children's Online Privacy Protection Act of 1998 and its rules (collectively, "COPPA") require us to inform parents and legal guardians (as used in this privacy policy, "Parents") about our practices for collecting, using, and disclosing Personal Information from children under the age of 13 ("Children") through our audience panelist engagement System which records and tracks viewing content for users of all ages. It also requires us to obtain verifiable consent from a child's Parent for certain collection, use, and disclosure of the child's Personal Information.

This Privacy Policy notifies parents of:

  • The types of information we may collect from Children

  • How we use the information we collect

  • Our practices for disclosing that information

  • Our practices for notifying and obtaining Parents' consent when we collect Personal Information from Children

  • How you can access and correct your child’s Personal Information

  • All operators that collect or maintain information from Children through our System

This privacy policy only applies to children under the age of 13 and supplements our general Privacy Policy (https://www.tvisioninsights.com/privacy-policy). Regarding the subject matter of this privacy policy, this privacy policy controls if there is a conflict between this policy and the general policy.

The Types of Information We Collect from Children

Our System collects information from you and individuals you identify as part of your household when you access or use our system, including individuals incidentally in the vicinity of the system, such as guests in your home. Children who access or use our system or are in the vicinity of the system will have information collected about them. 

We only collect as much information about a child as is reasonably necessary for the child to participate as a panelist in our TVision panelist program, and we do not condition his or her participation on the disclosure of more Personal Information than is reasonably necessary.

We may collect the following categories of information on our program participants from the applicable sources:

Information You Provide to Us:

We receive and store the following Personal Information that you provide to us about your child when you decide to participate in the program:

●     Identifiers such as first and last name; email address; physical address

●     Date of birth

●     Demographic information (gender, age, race, ethnicity, city and state)

●     Information about your media consumption habits

●     Phone number

Automatically-Collected Information

Whenever you or others interact with the System (including passively, by simply being in the vicinity of the system when it is on), we automatically receive and capture certain information from the system. This information may include:

●     Certain audience media consumption data

●     Certain audio data, allowing us to recognize media (TV, video, other) being consumed

●     Photos, images, and face geometry (a biometric identifier used for facial recognition)

●     Color and depth sensory data

●     Information about the devices used to view media

●     Information that identifies a device’s location and the owner of the device

●     IP address of your household (i.e., a numerical label that is connected to a computer network)

●     Online identifiers that we assign to you

Information from Third parties

We may also collect information about your child from third-party partners and clients.

How We Use Your Child's Information

We use the Personal Information we collect from your child to: 

  • Gather demographic information and information about audience engagement, behavior, attention and other media consumption habits, analyze that data, combine that data with other data, and create insights, statistics, analytics,  and anonymized segments and lookalike models and audiences;

  • Infer likely connections between different Internet-connected devices in a household;

  • Measure and analyze the effectiveness of advertising that viewers see while consuming media;

  • Enhance what we know about viewers by matching personal information against personal information that we receive from third parties, including partners and clients;

  • Allow third parties, including partners and clients, to match the personal information that we have about viewers, against their personal information that they have about the viewers (if any), and then creating their own insights, statistics, analytics, and anonymized segments and lookalike models and audiences;

  • Improve our services and offerings and create new ones;

  • Allow you to set up a user account and profile;

  • Contact you;

  • Respond to service requests;

  • Analyze how the System is used,

  • Respond to legal requirements, requests and actions, protect the security of our business and our participants, and enforce our terms

  • Other uses described under "Our Practices for Disclosing Children’s Information " below

Our Practices for Disclosing Children's Information

We do not sell children's Personal Information other than as described in this section.

We may disclose children's Personal Information as follows:

  • Clients: We may provide personal information and other information, in some cases in hashed form that may be reidentified, to our clients for their use for business, advertising, marketing, and analytics purposes. We may also provide aggregate usage data (e.g., viewing behavior and attention viewing behavior) to our clients who may use this data to improve the viewing experiences that they offer their viewers.

  • Partners: We may provide Personal Information and other information, in some cases in hashed form that may be reidentified, to our partners for their use for business, advertising, marketing, and analytics purposes. These partners may also use this information to create audience segments and look-alike audiences to help their clients identify potential customers and consumers of their offerings. They may also use this information in their online marketplaces to help their clients target audiences that may be interested in their products.

  • Affiliates: We may provide Personal Information to our corporate affiliates (e.g.: subsidiaries) to facilitate the operation of our business.

  • Vendors and Service Providers: We may employ third party vendors and service providers to perform tasks on our behalf, to enable the System technology, facilitate the operation of the program, or to help us provide our services and offerings to clients and partners. We may share your information with these parties to enable them to perform these functions. For example, we may use a data hosting service to store and process information that we collect through the System. Unless you are otherwise informed, these third parties do not have any right to use Personal Information we share with them beyond what is necessary to assist us.

  • Business Transfers: Your information may be transferred in the event of a merger, acquisition, reorganization, bankruptcy, receivership, sale of company assets, transition of service to another provider. Your information may be transferred to a successor or affiliate alone or as part of that transaction along with other assets.

  • Legal Requirements: We may disclose your information if required to do so by law or in the good faith belief that such action is necessary to (i) comply with a legal obligation, (ii) protect and defend the rights or property of TVision, (iii) act in urgent circumstances to protect the personal safety of users of the System or the public, or (iv) protect against legal liability.

  • With Your Consent: We may also share any information, including Personal Information and television and video viewing information, with any party when we have your consent.

Our Practices for Notifying and Obtaining Parents’ Consent 

Consistent with the requirements of COPPA, if you have Children who are under 13 residing in your household we will need to obtain prior verifiable consent from the Parent of each child before collection of Personal Information, unless the collection of information falls within an exception that is permitted by applicable law.  We will seek a Parent’s consent by email.

If you believe your child is participating in any activity that collects Personal Information and you or another Parent have not received an email providing notice or seeking your consent, please contact us at cs@tvisioninsights.com

If we do not receive parental consent within a reasonable time, we will delete any information we collected from the child in connection with that activity. 

We reserve the right to verify that the requester is in fact the child's Parent or legal guardian.  In any correspondence such as e-mail or mail, please include the child’s name and the Parent’s email address and telephone number.

If we do not have your consent to the collection of your child’s Personal Information, then you cannot participate in the program.

Accessing and Correcting Your Child's Personal Information

At any time, you may review the child's Personal Information maintained by us, require us to correct or delete the personal information, and/or refuse to permit us from further collecting or using the child's information. 

You can review, change, or delete your child's Personal Information by:
